The question arises: Would the study participant receive this radiation treatment even without participating in the clinical trial?
- If yes, it should be regarded as curative treatment and no nuclear coverage would be required.
- If no, nuclear coverage is required.
The insured sums are based on those of the trial subject insurance and are not cumulative.
What is covered by radiation liability insurance?
Insurance cover is provided for the use of radioactive substances or ionizing radiation on humans for the purpose of medical research or clinical trials, which requires approval in accordance with § 31 of the Radiation Protection Act (StrlSchG).
Unlike volunteer insurance, this is not a special type of insurance but rather liability insurance; in the event of a claim, the volunteer has no direct claim against the liability insurer.
The insurance cover includes radiation applications that are carried out in the context of the clinical trials specified in the insurance policy and conducted in the Federal Republic of Germany.
These can be: clinical trials that are subject to compulsory insurance in accordance with § 40a sentence 1 no. 3 of the German Medicinal Products Act (AMG) or § 26 para. 1 of the German Medical Products Law Implementation Act (MPDG) or clinical
trials that are not subject to the AMG or MPDG and are therefore insured with pure radiation liability insurance.
